What is bullying and harassment?

This animation introduces the key concepts surrounding bullying and harassment in the workplace, to help promote understanding and raise awareness of these issues.

It follows the Royal Society of Chemistry’s research on women’s retention and progression in the chemical sciences and LGBT+ physical scientists’ experiences of the workplace. These reports evidenced widespread incidences of discrimination, bullying, harassment and exclusionary behaviour in the workplace, which we are committed to helping eliminate.

We have also launched a bullying and harassment support line – https://www.rsc.org/new-perspectives/talent/bullying-and-harassment-support – to listen to those who are struggling to talk and to signpost toward resources which may help. What Qualifies As A Harassment Charge In Texas?

Harassment charges usually arise when an alleged victim receives some form of communication from the accused (in-person, phone, email, text) that annoys or alarms them to the point of calling the police. The biggest challenge for the police will involve proving that you were the person that made the communication and that you acted with criminal intent.

For example: many times criminal intent can be inferred based upon the nature of the contact. We have seen harassment cases where the accused has made hundreds of calls repeatedly to the alleged victim over a period of a few days. The more times the accused calls someone, the easier it is for the prosecution to infer criminal intent to annoy, alarm or abuse the alleged victim. Alternatively, if a call is made by the accused threatening the alleged victim with bodily injury or against a family member, the police can take this conduct and proceed forward with a harassment charge (if the call was made to harass or annoy), or a terroristic threat charge (if it placed the alleged victim in fear of the action).

Some of the more common examples of how citizens of Fort Worth, Texas and Tarrant County, Texas receive a criminal harassment charge are as follows: communicating with someone with intent of annoying, scaring or embarrassing them, requesting or describing sex acts with intent to annoy, threatening the alleged victim or their family, making false reports of death, calling repeatedly, etc.

Under Texas Penal Code, Section 42.07, the Tarrant County District Attorney’s Office must prove the following elements of harassment beyond a reasonable doubt:

A person commits an offense of harassment if, with intent to harass, annoy, alarm, abuse, torment, or embarrass another, he:

• Initiates communication by telephone, in writing, or by electronic communication and in the course of the communication makes a comment, request, suggestion, or proposal that is obscene;

• Threatens, by telephone, in writing, or by electronic communication, in a manner reasonably likely to alarm the person receiving the threat, to inflict bodily injury on the person or to commit a felony against the person, a member of his family or household, or his property;

• Conveys, in a manner reasonably likely to alarm the person receiving the report, a false report, which is known by the conveyor to be false, that another person has suffered death or serious bodily injury;

• Causes the telephone of another to ring repeatedly or makes repeated telephone communications anonymously or in a manner reasonably likely to harass, annoy, alarm, abuse, torment, embarrass, or offend another;

• Makes a telephone call and intentionally fails to hang up or disengage the connection;

• Knowingly permits a telephone under the person’s control to be used by another to commit an offense under this section; or
sends repeated electronic communications in a manner reasonably likely to harass, annoy, alarm, abuse, torment, embarrass, or offend another.

What Is Considered Harassment?

Harassment in Oklahoma is one of several specific statutory grounds when a court can enter a protective order. And in my experience, this is one of the most common reasons you see protective orders being sought is on allegations of harassment. This is a really common thing you see. But what does that actually mean legally speaking?

Well, we can go to Title 22, section 60.1 that gives you the legal definition for the purpose of the statute. Under this statute, it’s defined as “a knowing and willful course or pattern of conduct by a family or household member, or an individual who is or has been involved in a dating relationship with the person, directed at a specific person, which seriously harms or annoys the person and in which serves no legitimate purpose.”

It goes on to say that “the course of conduct must be such as would cause a reasonable person to suffer substantial emotional distress, and must actually cause substantial emotional distress to the person.”

Let’s unpack that real quick. Harassment has to be a knowing and willful course or pattern of conduct. So, the first thing that’s an obvious thing with harassment is for it to be harassment, it has to be more than a one-off incident.

In most places the term has both a legal definition and a more common understanding. In the law, true harassment is often very difficult to prove. It usually requires a sustained pattern of behavior or speech that is intentionally designed to harm another person or cause some sort of pronounced distress, plus some sort of actual damages that result.

VLSB+C Sexual Harassment Report

What should you do if your landlord is harassing you?

Many landlords have a federally backed loan and some restrictions come with those loans, especially regarding eviction.

Landlords don’t like that, and they will shut off their tenants’ utilities or call DHR on them saying they suspect child abuse. Anything to get their tenants out of their property.

However, if there’s a proper lease agreement the landlord has to follow the rules.

If a landlord decides to change the locks and throw all of your stuff out because you’re a couple months behind on rent, you need to serve that landlord with a huge lawsuit.

Too often we see landlords shut off their tenants utilities, and then come after the tenant with a debt collector for money damages.

They will sue tenants and try to get more money from them.

If your landlord is violating the law by harassing you and trying to evict you, definitely look into suing them.

You may have rights under your State Landlord/Tenant Act, the company violating the law may be considered a debt collector, and you may have some other state laws that protect you from being illegally evicted.

Get with a consumer lawyer in your state to help you with your case, and punish these landlords from breaking the law.
